Chapter 7 - Straight Bankruptcy

If you owe more money than you can be expected to pay in the near future, you may want to consider Chapter 7. Chapter 7 allows the debtor to have the Court "discharge" or cancel most of his or her debts to obtain a fresh start. Chapter 7 generally stops bill collectors from calling you and prevents creditors from garnishing your wages. You may be able to protect most of your personal property through Chapter 7.

Chapter 13 - Wage Earner Plan

If you have a steady source of income through wages, self-employment, support, or government benefits, you may be able to file Chapter 13. This plan offers a way for you to reorganize your finances, allowing you to pay part or all of the debts over a three to five year period under court supervision. During this time, most creditors are prevented from starting or continuing collection efforts.
