Widows and Widowers

Widows and widowers can apply for SSD based on their spouse’s work record if they have not worked enough quarters themselves to be eligible. The Social Security Administration knows that in many families, the husband or wife works full‐time while their spouse stays home or works only part‐time. The death of the full‐time worker severely effects the financial stability of the person who has stayed home to support the family in ways other than financial.

To be eligible for disabled widows or widowers benefits, you must be age 50 or over, be totally disabled from work and your disability must occur within seven years of your spouse's death.

Also, your spouse must have paid enough into Social Security so that they would have been eligible to receive benefits before they died.

At Jeffrey Freedman Attorneys at Law, our experienced attorneys can answer your questions about whether you qualify for SSD or SSI, and improve your chances of receiving benefits. We have 14 accessible, conveniently located offices in Western New York and Pennsylvania.
