Workers’ Compensation claims can hang in the balance for many years before a claimant receives a just settlement, especially if the claimant is not represented by an attorney who has expertise in WC cases. This was the case of a woman who suffered from a chronic back injury that dated back to the 1990’s. She had filed claims in the ‘90s and again in the early 2000’s, and had not received satisfaction on any of her cases.
“When we came into the picture, the Special Funds Conservation Committee, which is a state agency, was the responsible insurer,” said Jeffrey Freedman, managing partner, Jeffrey Freedman Attorneys, PLLC. “The attorney who worked on this case for us, John Federice, was able to get a positive result on her three claims in April of this year.”
The claimant received a settlement of $105,000 and the medical care she requires related to the injury will be covered for the remainder of her lifetime, paid for by Special Funds.
“These cases are complicated, especially where more than one claim is involved,” Freedman said. “John was able to put together the medical documentation necessary to convince Special Funds this woman deserved compensation for the injury she had suffered.
“Negotiating with agencies like Workers’ Compensation is an involved business, but when the case is in the hands of someone who is experienced and knows the law, the client has a much better chance of getting a fair settlement.”
