We Handle VA Disability Cases Nationwide

These tax-free benefits can also be paid to veterans who were disabled due to VA healthcare and those whose injuries were made worse by active military service.

Types of disabilities that are eligible for benefits
  • Post-traumatic stress disorder (PTSD)
  • Depression
  • Fibromyalgia
  • Toxic exposure/cancer
  • Traumatic brain injuries/migraine headaches
  • Neck and back injuries
  • Military sexual trauma
  • Hearing problems
  • Gulf War syndrome
  • Total disability/individual unemployability
  • And others

VA Disability Benefits and the application process are different than traditional Social Security benefits. Unfortunately, the process can be long and complex. In general, you may be eligible for VA benefits if you served in the Army, Navy, Air Force, Coast Guard, or Marines and have an illness or injury that was related to your service. You must also have received an honorable discharge. If you’ve been discharged under any other circumstances, it could impact your eligibility for VA Disability Benefits.

How do I apply?

Applying for VA Disability Benefits can be a long process. You’ll be required to provide extensive documentation of your medical history, service records, and more. You can apply online, in person, or by mail.

If you’re unable to work because of a service-related disability, you may also be entitled to Social Security disability benefits.

Hiring an Attorney

Even though you’ve served our country and sacrificed so much, there is no guarantee you’ll be awarded benefits. If you’re beginning the process of applying for benefits and you’re concerned your claim will be denied, or if it has already been denied, it is time to schedule a consultation with us. Our consultations are free, and we won’t collect any fees unless we win your case.

Common Questions

We’ve helped many disabled veterans just like you secure the benefits they deserve. Over the years, many of our clients have asked the same questions concerning the application and appeal process.

If I receive VA Disability Benefits, am I eligible for Social Security benefits too?

While you can receive both benefits at the same time, securing VA Disability Benefits doesn’t automatically make you eligible for Social Security benefits or vice versa.  Each program has their own requirements and application process.  You’ll need to review each program’s requirements to determine your eligibility.

Will Jeffrey Freedman Attorneys help me with the application process? Or do I have to wait until my claim has been denied?

We are happy to talk with you at any point in the process.  Please contact us for a free consultation whenever you are concerned about obtaining benefits.

Can you represent veterans in other states besides New York?

Yes, we can represent veterans throughout the country.

How long does the VA typically take to decide on a claim?

It can take months, even up to a year for the VA to decide on a claim.  We can try to expedite the process for you by ensuring you have all the necessary documentation upfront so that when your case is reviewed, the VA has a clear picture of your health and can make a determination on your case without having to ask for more information.

My VA Disability Benefits claim was denied. Now what?

If your claim has been denied, contact us for a free consultation.

My spouse died as a result of a military injury. What am I entitled to?

There are a number of benefits available to surviving spouses.  You may be entitled to ongoing benefits including pension, educational assistance programs, home loans, burial support and more.

Will you represent someone that has been a victim of Military Sexual Trauma?

Yes, Military Sexual Trauma is now being recognized by the VA and we would be happy to represent you.
